2011 could have been named the year of the cell phone camera. Individuals everywhere have used their cell phones or other electronic devices to record interactions with the police. Some States have taken offense to that and have allowed police officers to arrest people for documenting events in public. In 2011, the First Circuit Court of Appeals out of Massachusetts ruled in favor of citizens first amendment rights to record in public. The Court has jurisdiction over MA, NH, RI, ME, and Puerto Rico. Here’s the ruling: www.ca1.uscourts.gov *** Some excerpts: “[I]s there a constitutionally protected right to videotape police carrying out their duties in public? In such traditional public spaces, the rights of the state to limit the exercise of First Amendment activity are ‘sharply circumscribed.’” “[A] citizen’s right to film government officials, including law enforcement officers, in the discharge of their duties in a public space is a basic, vital, and well-established liberty safeguarded by the First Amendment.” “Gathering information about government officials in a form that can readily be disseminated to others serves a cardinal First Amendment interest in protecting and promoting ‘the

@tittiger – so you’re saying that if New York, or California, or New Hampshire wanted to ban free speech, they could? If those states wanted to disarm their populations, they could? If they wanted to execute people without due process, they could? If so, then what is stopping them?

  3. sober502 Says:

@tittiger – right, my understanding though is that changed with the passage of the 14th amendment and Supreme Court rulings during the late 1800s.

  4. tittiger Says:

@sober502 You as most Americans seem to have no understanding of what the Constitution is if understand your comment as you believing that the Constitution applies to the States.

  5. sober502 Says:

@tittiger – 14th amendment…. No state would be allowed to abridge the “privileges and immunities” of citizens.

  6. tittiger Says:

Quit twisting and torturing the Constitution please!

Doesn’t matter if it is a 1st amendment right. The 1st only applies to laws that the Feds make.

Nothing to do with the states.

It does not give us any right or rights.

HOWEVER the right to film our employees in public is a God given inalienable right!!

There is a West Point Grad/Army Ranger who needs your help. He took pictures of cops abusing 2 women, and was falsely charged because of his actions. Search Youtube for the story. It’s right here on Youtube. Find us on Facebook at “Free Antonio Buehler” to show your support, learn how to help, and stay updated.

@shnugz786 – I would hope so considering the UK is a surveillance state with cameras everywhere. I would do some research though because I can’t tell you for sure. Sadly the only way any law against recording will get overturned is for people to get arrested and sue in court.. repeatedly.

  17. shnugz786 Says:

i know i can probably just search this up on the net but still wana ask although i think i know the answer..is it legal to record in the UK-specificly England
